Terms of Service

By accessing or using the ListWyse platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including visitors, registered users, and paying customers.

ListWyse provides an AI-powered photo enhancement platform designed for real estate professionals. The Service allows users to upload property photographs and receive AI-processed outputs including, but not limited to, virtual staging, lighting correction, decluttering, and general image enhancement.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

You must be at least 18 years of age and capable of forming a legally binding contract to use this Service. By using the Service you represent and warrant that you meet these requirements. The Service is intended primarily for real estate professionals, agents, brokers, and property managers.

To access certain features you must create an account. You agree to provide accurate, complete, and current information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@listwyse.com if you suspect any unauthorised use of your account.

You agree not to use the Service to:

• Upload content that is unlawful, defamatory, obscene, or infringes any third-party intellectual property rights.
• Misrepresent property conditions in a manner that could deceive or mislead prospective buyers or tenants.
• Attempt to reverse-engineer, copy, or reproduce the underlying AI models or platform infrastructure.
• Circumvent any security measures, access controls, or usage limits imposed by the Service.
• Use the Service for any purpose other than legitimate real estate marketing and photography enhancement.
• Introduce malicious code, viruses, or any other harmful material.

We reserve the right to suspend or terminate your account if we believe you are in violation of these terms.

Your content: You retain all ownership rights to the original photographs you upload. By uploading content, you grant ListWyse a limited, non-exclusive, royalty-free licence to process, store, and transmit your images solely for the purpose of delivering the Service.

AI-generated outputs: Ownership of AI-enhanced images generated from your uploads is assigned to you upon successful delivery, subject to continued compliance with these Terms and full payment of applicable fees.

Our platform: All other intellectual property in the Service, including trademarks, software, models, design, and documentation, remains the exclusive property of ListWyse Ltd. Nothing in these Terms grants you any rights to use the ListWyse name, logo, or branding.

Certain features of the Service are offered on a paid basis. All fees are stated in USD unless otherwise indicated and are exclusive of applicable taxes. Payment is processed securely via Stripe. By providing payment details, you authorise us to charge the applicable fees.

Credits purchased are non-refundable except as required by applicable law or as described in our refund policy. Subscription plans renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription at any time from the Settings page.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs will meet every user's expectations or quality standards.

AI image enhancement is a computational process and results may vary. ListWyse does not guarantee that enhanced images will be accepted by any particular property portal, MLS, or listing platform.

To the fullest extent permitted by law, ListWyse Ltd, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claim arising out of or related to the Service shall not exceed the amount you paid to ListWyse in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless ListWyse Ltd and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your breach of these Terms.

You may terminate your account at any time by contacting us at support@listwyse.com. We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, if we believe you have violated these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply.

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, notify you by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
